Summary Statement
The Delaware Department of Justice is seeking an exceptional and highly motivated individual to join the Affirmative Litigation Unit within the Civil Division in the New Castle County office as a Deputy Attorney General.
The Affirmative Litigation Unit (ALU) represents the State of Delaware in a wide variety of novel and interesting civil and administrative matters. This Deputy Attorney General (DAG) position handles two key parts of ALU’s responsibilities: (1) serving as general counsel to the Unemployment Insurance Appeal Board (UIAB) and (2) conducting administrative prosecutions to enforce the rules and regulations of the many boards and commissions that regulate professional conduct in Delaware pursuant to Title 24 and 29 Del. C. § 8735. The DAG will also be assigned other duties by Unit leadership on an as-needed basis.
Essential Functions
As UIAB general counsel, the DAG will review appeals to the Board for timeliness, provide legal advice to the Board at hearings, draft decisions, and represent the Board in Rule 72 appeals to the Superior Court. This is a fast-paced position that handles a significant volume of cases for the UIAB. Specific duties include attending hearings, drafting numerous opinions and orders, legal research, and other UIAB legal matters as needed.
ALU’s administrative prosecutors appear on behalf of the State in administrative disciplinary hearings against licensees who are alleged to have violated the statutes and regulations of their professions. ALU DAGs are on the front line of protecting the public from unprofessional conduct.
Job Requirements
Required skills for this DAG position include being a self-starter with the ability to handle complex legal issues independently; quickly evaluating and determining cases; anticipating legal issues; the ability to conduct legal research accurately and effectively; and giving sound legal advice to clients based upon the relevant regulations, statutes, caselaw and other authorities.
ALU DAGs must be able to develop a good working relationship with other DAGs, Board members, support staff, law enforcement, and agency personnel. ALU DAGs must have the determination, ability, and judgment to quickly learn and independently apply the relevant laws, regulations, and court rules. Must be a member of the Delaware Bar or eligible to practice law pursuant to Delaware Supreme Court Rule 55.
Conditions of Hire
